1.2 In these Terms and Conditions the words “we”, “our” and “us” refer to School Style Ltd and “the site” refers to the web site that is found at www.myschoolstyle.com.
1.3 Accessing the site means that you are agreeing to be bound by our terms and conditions and that you accept our privacy policy. Should you object to our terms and conditions you should not use the site.
1.4 We reserve the right to change any part of this agreement without notice and we advise users to regularly check the Terms and Conditions of this agreement.
1.5 You agree to be fully responsible for any claim, expense, liability, losses or costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.
1.6 Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of School Style or any of its employees.
2. USING THE SITE
2.1 When you use www.myschoolstyle.com you are committing that :
2.1.1 Any details you provide to us are current, accurate and complete.
2.1.2 You agree to us using Email as a means of communicating with you.
2.1.3 You agree that you shall not use the site for illegal purposes, and will respect all applicable laws and regulations.
2.1.4 You agree to be fully responsible for any claim, expense, liability, losses or costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.
2.2 We will Email you as soon as possible after you place an order to acknowledge the receipt of that order and you must check all the details on this acknowledgement email are correct and contact us as soon as possible if any you disagree with any information in the email.
2.3 All orders placed on myschoolstyle.com are subject to acceptance by us and no contract for the sale of any product will exist until we have accepted the order.
2.4 Our acceptance of your order will take place when we have advised you by Email that we have dispatched your order. Only those items detailed in this e-mail will be included in the contract formed. In processing your payment and acknowledging your order we are not legally accepting your order.
2.5 If your order has not been accepted, you will receive an explanatory email detailing the reasons why.
3. THE WEBSITE
3.1 We take care in the preparation of the content of this website to ensure that all items for sale are described and priced fully and accurately. However the following points should be noted :
3.1.1 Should there be any errors, howsoever caused, in the pricing and/or description of items being ordered at the time of the order we are not obliged to supply the incorrect goods or goods at the incorrect price and it may mean that the order is not accepted.
3.1.2 Many schoolwear items are exempt from VAT and others attract VAT full rate (currently 20%). All items are displayed inclusive of VAT regardless of whether this is 0% or full rate.
3.1.3 School Style Ltd shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.
3.1.4 School Style Ltd retain the right to modify, add or remove any part of this site without warning and will not be liable for any consequences arising from such action.
3.1.5 We try to accurately display the colours of all our products. However, as the actual colour reproduction you view will depend on your particular model of display screen, its settings and its condition, we cannot absolutely guarantee that it will accurately display the colour of any individual product.
3.1.6 We cannot guarantee totally uninterrupted availability of the site nor do we guarantee that the functionality of the site will be 100% free of errors.
3.1.7 The views expressed in any user generated content are the opinions of those users and may or may not be the views of School Style Ltd.
3.1.8 Myschoolstyle.com may contain hyperlinks to other websites operated by third parties. We do not control these websites and will not be liable in respect of the use of these websites.
3.1.9 The content on myschoolstyle.com is displayed for the purposes of promoting our range of products in the United Kingdom. Anyone choosing to use this site from outside the UK is responsible for compliance with any local laws that may apply
4. WEBSITE SAFETY AND SECURITY
4.1 We make every effort to ensure that this website is free from viruses or defects. However access is via the world-wide web which you use at your own risk and it is your responsibility to ensure that the right hardware and software is deployed when accessing the site to ensure that no damage is done.
4.2 School Style Ltd shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
4.3 In using the site, you agree not to do so in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the site. You also agree not to compromise the security of the site or to attempt to gain unauthorised access to secured areas or sensitive information.
4.4 If you elect to set up a user account on myschoolstyle.com you will be asked to provide a username and password. You are responsible for maintaining the confidentiality of these and for all activity that occurs under your account login details. We shall not be liable for any loss or damage which may arise as a result of any failure by you to protect your password or account.
5. DELIVERY AND TITLE
5.1 myschoolstyle.com offers both a standard and an express delivery service. These delivery services are provided by third parties which may change from time to time as we seek the best value and quality of service.
5.2 Standard service delivery times may vary but should be 2-5 days while goods dispatched on orders where the Express Service has been selected will be delivered by our preferred home delivery service using a next working day service. It does not guarantee that items will be delivered the day after they are ordered.
5.3 All delivery timescales indicated are target timescales which we aim to achieve on a best endeavours basis but which we are not contractually obliged to meet. Timescales quoted for standard and Express Service are measured from the point of dispatch.
5.4 Goods will be dispatched to the address details that you give us.
5.5 If your order is for multiple items and one or more of the items are out of stock or delayed then we reserve the right to dispatch goods to you on more than one shipment at no additional cost to you.
5.6 Upon delivery to you the goods shall be at your risk. Regardless of delivery having been made the title in the goods will not pass to you until such time as payment is made in full for those goods.

5.8 Once an item has been delivered and recorded as such by our delivery partner then School Style is no longer responsible for any items which become damaged or lost. In these circumstances the customer should make a claim from that delivery organisation.
6. PAYMENT
6.1 When you buy on the site you are committing that you are authorised to use the credit card or other means of payment with which you are paying and that you have the means to make payment.
6.2 We accept card payment by Visa, Mastercard, American Express, Maestro, JCB, Delta and we must receive payment for goods and delivery prior to processing your order.
6.3 All card payments are processed securely. For information on this please refer to our safe shopping page.
6.4 All card transactions are subject to authorisation by the card issuer. In the event that the issuer refuses to authorise payment we may cancel the order and will not be liable for any non-delivery or delay in delivery.
6.5 You have the option to pay by cheque in which case you must provide order details with your cheque and we reserve the right to hold the processing of your order until payment has cleared.
6.6 If you are ordering as a school on a credit account basis then payment shall be due 30 days from the date of the invoice. Time shall be of the essence for payment and we reserve the right to cancel your credit terms if payment is not made when due. Further we reserve the right to charge interest on the overdue amount at the rate of 2% over the current base rate as published by National Westminster Bank at that time.
6.7 We reserve the right to terminate this agreement and to refuse any orders from you if you fail to pay us when payment is due.
7. AVAILABILITY AND DELAYS
7.1 Through holding stock and supply chain arrangements we endeavour to meet all orders within our stated target delivery timescale. From time to time it is possible that there is insufficient stock to supply the goods ordered. In this circumstance we will contact you and may, at our discretion, suggest an alternative of the same or higher quality.
7.2 You are under no obligation to accept our suggestion and can cancel your order.
8. CANCELLATIONS, AMENDMENTS, RETURNS & EXCHANGES
8.1 The www.myschoolstyle.com site gives you the option to amend or cancel your order(s) right up until the point that you enter payment and confirm your order. If you need to amend or cancel an order after that point you must contact us immediately. Once payment has been taken then no amendments can be made on the site.
8.2 Cancellation
8.3 The distance selling regulations provide you with the legal right to cancel your order with us for any reason and return the goods within seven working days of receipt of the goods. The first of these seven days is the day after the date of receipt of the goods. This does not apply to items which have been embroidered or in any other way customised for you. Where items have been tailored for your particular order, for instance with a school emblem, then once payment is taken, no changes to the order or any cancellation may be made, except in accordance with your legal rights and if one or more of the following applies :
- If there is a fault with the garment
- If the garment supplied differs in specification to that advertised
If you have ordered a garment of the wrong size which has been embroidered and you wish to exchange it for the correct size then you should contact us to make arrangements.
8.4 If you wish to cancel an order after payment has been taken then you should advise us as soon as possible. We will process any cancellation when we receive your formal notification that you wish to cancel an order. Provided that the goods are received back by us within the allowed time period, in the same condition that they were when we sent them to you, unwashed and in the original undamaged packaging then we will re-credit any sum that we have debited from your credit card for the goods in question or send you a cheque should you have paid by this means.
8.5 We will also refund your original delivery charge when a product is faulty, damaged or has been incorrectly described by us. In other circumstances we will deduct from any refund our standard P&P charge (currently £1.99) or the actual carriage costs we incurred (whichever is the higher).
8.6 Returns, Refunds and Exchanges
8.7 With the exception of any items which are embroidered or in any other way personalised for your order products ordered from us can be returned to us for full refund or exchange providing that we receive the items within 14 days from when you received them. The first of those 14 days will be the day after the date of receipt by you.
8.8 To qualify all goods must be unused, unwashed, unaltered, in the same condition in which they were orginally supplied and in their original undamaged packaging, with hangers when supplied and accompanied by the paperwork that clearly identifies the order from which the return arises.
8.9 You are responsible for the cost of returning the items and you do so at your risk. Please note that where no or insufficient postage stamp is attached to a returned package then it will not reach us and Royal Mail will return it to you.
8.10 On receipt all items will be inspected and if the product returned is not in a fully resaleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item. This does not affect your statutory rights.
8.11 When we accept a return we will re-credit your credit card with the sum originally debited for the goods in question or send you a cheque should you have paid by this method. We will also refund your original delivery charge when a product is faulty, damaged or has been incorrectly described by us. In other circumstances we will deduct from any refund our standard P&P charge (currently £1.99) or the actual carriage costs we incurred (whichever is the higher).

8.13 You cannot return items for refund which have been tailored for your particular order, for instance with a school emblem, except in accordance with your legal rights and if one or more of the following applies :
- If there is a fault with the garment

If you have ordered a garment of the wrong size which has been embroidered and you wish to exchange it for the correct size then you should contact us to make arrangements.
8.14 If you return an embroidered item because it is faulty or because it differs to the advertised specification we will replace the item with a new garment made to meet the advertised specification.
Product faults are rare as all items are checked and those that undergo embroidery are checked again. Should you want to report an item that is faulty or to return an item for exchange that is faulty you should notify us within 48 hours of receipt. We cannot normally consider an exchange once the item has been used or worn
8.15 These provisions do not affect your statutory rights.
9. OWNERSHIP OF RIGHTS
9.1 Copyright and all other rights in this website are owned by School Style Ltd.
9.2 By using the Website you agree to respect those rights and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the website.
10. FORCE MAJEURE
10.1 School Style Ltd shall have no liability for any failure to deliver, costs incurred or for damage to goods supplied caused by any event outside our reasonable control.
11. TERMINATION
11.1 We reserve the right to terminate our agreement with you and to refuse any orders if you are in breach of any of our terms and conditions, you fail to pay when payment is due or we suspect you are or have been involved in any illegal activity on our site.
12. SEVERANCE
12.1 If any part of this Agreement is invalid or unenforceable the remaining conditions shall remain in force.
13. GOVERNING LAW AND JURISDICTION
13.1 The myschoolstyle.com website and its content and any contract arising from the use of the site are governed by the laws of the United Kingdom. Users of the site agree to be bound exclusively by the jurisdiction of the courts of the United Kingdom.
13.2 These terms and conditions do not affect your statutory legal rights.
